TRAVEL

DOES THE INCIDENT SCENE MEET LOCAL STANDARD?

Whether a winter or summer holiday, the most common investigation centres on a claim made under UK Law via The Package Travel and Linked Travel Arrangements Regulations 2018. Heard before a UK Court, its adjudication is judged  on what constitutes the exercise of reasonable skill and care in the performance of the holiday contract defined by the local standard that applied in the resort on the date and at the time of the. incident.

In other jurisdictions, the evidential test applied may be different.

TYPES OF STANDARDS INVESTIGATED

All types of incident considered but most common investigations include: balcony falls; floor slips; pool features; carbon monoxide poisoning; access routes including stairways and ramps; fire precautions, lighting, electrical shock and chemical incidents

When did the lorry load slip and roll it over?

Could collision have been avoided?

Were the headlamps working? Did the seat belt pretensioner activate?

How did the coach fire start?

Was this a suspicious collision?

Does the technical evidence meet the test for corporate manslaughter?
